‘Plevin’ complaints are based on a court case in the Supreme Court which held that a failure to disclose a ‘large’ commission payment on a PPI policy created an unfair relationship between the lender and the consumer.

  • What does this mean for my PPI policy?
Even if the PPI was a suitable product, if the commission was not disclosed to you the sale itself is likely to be deemed unfair.
  • Does this apply if my PPI claim was previously rejected?
Yes, if you have previously tried to claim for mis-sold PPI but have been rejected, the complaint can be re-investigated on this basis.
  • What if I have already had a successful PPI claim?
If you previously complained about PPI and were refunded some or all of the money which you have paid, you will not get back more money if there is no remaining loss to claim back.
  • Have you received an offer through the post? It may not be enough!
Throughout late 2017, lenders sent letters to customers who had a previous PPI complaint rejected. In most cases, lenders are paying back a proportion of the commission that they received. Unfortunately, lenders are not usually paying back all of the commission they received! Marland Thomas do not think the payments are sufficient enough and we are advising clients like you to pursue a claim for a full refund.
